These Terms of Service may sound serious, but they are only meant to clearly outline the rules and protect both sides. Please don’t be afraid to reach out, ask questions, or talk things through! I value friendly communication and a comfortable collaboration ❤

1. GENERAL INFORMATION

▸ By commissioning me or purchasing my products, you agree to these Terms of Service. Lack of knowledge of these terms does not exempt you from following them.
▸ When sharing my work online or elsewhere, proper credit must always be given.
▸ Removing, altering, or obscuring my watermark is strictly prohibited.
▸ NSFW artwork is available only to clients who are 18 years of age or older.
▸ My artwork may not be used for AI training, AI datasets, image generation, or similar technologies under any circumstances.

2. CONTACT & ORDERING

▸ Orders can be placed via my commission order form or by contacting me directly through social media (Telegram, X, Discord, etc.). Telegram is the fastest way to reach me.
▸ Please start your message by clearly stating that you are interested in commissioning artwork. Due to the high volume of messages such as greetings (e.g. "hi") or stickers/emojis, I may not respond to messages that do not clearly indicate an order inquiry.
▸ If my order form is closed, I am not accepting new commissions at that time.
▸ Clients are responsible for providing clear and complete information before work begins.
▸ Visual references are required. A text-only description of a character is not sufficient. Helpful references include character sheets, pose ideas, mood boards, sketches, or photobashes. If the client grants me creative freedom, a single reference sheet is sufficient.
▸ I reserve the right to decline any commission request for any reason.

3. PAYMENT

▸ Full payment is required upfront before any work begins.
▸ Payment must be completed within 7 days of confirming the order. Failure to do so may result in cancellation.
▸ Payment deadline extensions may be granted at my discretion.
▸ All prices are listed in EURO (€) and are non-negotiable.Accepted payment methods:

ㅤㅤ◦ Bank transfer and BLIK (Poland only; payment must be converted to PLN using the exchange rate on the day of payment)▸ Prices may increase for complex designs (e.g. large wings, intricate patterns, tattoos, non-standard species, more than four limbs, etc.).
▸ If a commission is canceled after work has started, a partial refund may be issued depending on the stage of completion.
▸ No refunds are available once the artwork is completed and delivered.

4. WORK PROCESS & REVISIONS

▸ Work begins only after payment has been received.
▸ Completion time depends on complexity and workload. Typical turnaround 1–4 months, unless otherwise stated.
▸ If delays occur, I will inform you as soon as possible.
▸ Deadlines must be discussed before placing an order. Rush commissions may incur additional fees.
▸ Minor revisions may be allowed during the sketch stage. Major changes or additional revisions may require extra payment.
▸ Final artwork is delivered as an uncompressed PNG file unless agreed otherwise.

5. COPYRIGHT & USAGE RIGHTS

▸ All commissioned artwork is for personal use only, unless explicitly stated otherwise in writing.
▸ Commercial usage (including but not limited to merchandise, branding, promotion, resale, or monetized content) requires a separate agreement and additional fees.
▸ I retain full copyright to all artwork I create.
▸ I reserve the right to display commissioned artwork in my portfolio, social media, and other promotional materials unless a prior NDA is agreed upon.
▸ Clients may not resell, redistribute, trace, modify, or claim my artwork as their own.

6. NDA (NON-DISCLOSURE / PRIVATE COMMISSIONS)

▸ NDA requests must be discussed before payment is made.
▸ A full NDA, where I am not allowed to publicly share the artwork in any form (including portfolio and social media), is subject to an additional fee.
▸ If the NDA applies only until a specific agreed-upon date, after which I may publish the artwork, no additional NDA fee is required unless stated otherwise.
▸ If the client requests that I do not mention their name or identity, but still allows me to publicly share the artwork, no NDA fee applies.

7.PHYSICAL MERCHANDISE

▸ Physical merchandise (prints, stickers, etc.) is sold for personal use only.
▸ Colors may vary slightly due to screen settings and printing differences.
▸ I am not responsible for damage or loss caused by postal services once the package has been shipped.
▸ Returns or refunds for physical items are handled on a case-by-case basis, depending on the issue.

8.FINAL NOTES

▸ I reserve the right to update these Terms of Service at any time.
▸ Changes to prices or terms do not apply retroactively to commissions already paid for.

By commissioning or purchasing from me, you confirm that you have read, understood, and agreed to these Terms of Service.

Ten regulamin może brzmieć poważnie, ale jego celem jest jedynie jasne ustalenie zasad i ochrona obu stron. Nie bój się pisać ani zadawać pytań! Zależy mi na miłej, komfortowej współpracy i otwartej komunikacji ❤

1. INFORMACJE OGÓLNE

▸ Złożenie zamówienia lub zakup moich produktów oznacza akceptację niniejszego Regulaminu. Nieznajomość zasad nie zwalnia z obowiązku ich przestrzegania.
▸ Przy udostępnianiu moich prac zawsze należy podać mnie jako autora.
▸ Usuwanie, modyfikowanie lub zasłanianie mojego znaku wodnego jest surowo zabronione.
▸ Prace NSFW są wykonywane wyłącznie dla osób pełnoletnich (18+).
▸ Nie wyrażam zgody na wykorzystywanie moich prac do trenowania modeli AI, generowania obrazów przez AI ani do żadnych zbiorów danych AI.

2. KONTAKT I SKŁADANIE ZAMÓWIEŃ

▸ Zamówienia można składać poprzez formularz zamówień lub kontaktując się ze mną bezpośrednio przez media społecznościowe (Telegram, X, Discord itp.). Najszybszą formą kontaktu jest Telegram.
▸ Proszę, aby w pierwszej wiadomości jasno zaznaczyć chęć złożenia zamówienia. Ze względu na dużą liczbę wiadomości typu „hi”, naklejek lub emoji, mogę nie odpowiadać na wiadomości, które nie wskazują wyraźnie, że dotyczą zamówienia.
▸ Jeśli formularz zamówień jest zamknięty, oznacza to, że aktualnie nie przyjmuję nowych zleceń.
▸ Klient jest zobowiązany do dostarczenia jasnych i kompletnych informacji przed rozpoczęciem pracy.
▸ Referencje wizualne są wymagane. Sam opis tekstowy postaci nie jest wystarczający. Pomocne są m.in. reference sheets, propozycje póz, moodboardy, szkice lub photobashe. Jeśli klient daje mi creative freedom, wystarczy jeden reference sheet.
▸ Zastrzegam sobie prawo do odmowy przyjęcia dowolnego zamówienia bez podania przyczyny.

3. PŁATNOŚCI

▸ Wymagana jest pełna płatność z góry przed rozpoczęciem pracy.
▸ Płatność musi zostać dokonana w ciągu 7 dni od potwierdzenia zamówienia. Brak płatności w tym terminie może skutkować anulowaniem zlecenia.
▸ W wyjątkowych przypadkach mogę zgodzić się na przedłużenie terminu płatności.
▸ Wszystkie ceny podane są w EURO (€) i nie podlegają negocjacji.Akceptowane metody płatności:

ㅤㅤ◦ Przelew bankowy oraz BLIK (Polska; kwota musi zostać przeliczona na PLN według kursu z dnia płatności)▸ Cena może wzrosnąć w przypadku skomplikowanych projektów (np. duże skrzydła, wiele detali, tatuaże, niestandardowe gatunki, więcej niż cztery kończyny itp.).
▸ W przypadku anulowania zamówienia po rozpoczęciu pracy możliwy jest częściowy zwrot, zależny od etapu realizacji.
▸ Po ukończeniu i dostarczeniu pracy zwroty nie są możliwe.

4. PROCES PRACY I POPRAWKI

▸ Praca rozpoczyna się dopiero po otrzymaniu płatności.
▸ Czas realizacji zależy od stopnia skomplikowania i aktualnego obłożenia –zazwyczaj wynosi od 1 do 4 miesięcy, o ile nie ustalono inaczej.
▸ W przypadku opóźnień poinformuję o nich najszybciej jak to możliwe.
▸ Jeśli praca ma być gotowa na konkretną datę, należy to ustalić przed złożeniem zamówienia. Zlecenia ekspresowe mogą wiązać się z dodatkową opłatą.
▸ Drobne poprawki są możliwe na etapie szkicu. Większe zmiany lub dodatkowe poprawki mogą wymagać dopłaty.
▸ Gotowa praca przekazywana jest w formacie PNG bez kompresji, o ile nie ustalono inaczej.

5. PRAWA AUTORSKIE I UŻYTKOWANIE

▸ Wszystkie zamówione prace przeznaczone są wyłącznie do użytku prywatnego, chyba że ustalono inaczej.
▸ Wykorzystanie komercyjne (w tym m.in. merch, branding, promocja, odsprzedaż, treści monetyzowane) wymaga osobnej umowy oraz dodatkowej opłaty.
▸ Zachowuję pełne prawa autorskie do wszystkich wykonanych przeze mnie prac.
▸ Mam prawo publikować zamówione prace w swoim portfolio, mediach społecznościowych i materiałach promocyjnych, chyba że wcześniej uzgodniono NDA.
▸ Zabronione jest odsprzedawanie, redystrybuowanie, modyfikowanie, trasowanie lub przypisywanie sobie autorstwa moich prac.

6. NDA (POUFNOŚĆ / ZAMÓWIENIA PRYWATNE)

▸ Wszelkie prośby o NDA muszą zostać omówione przed dokonaniem płatności.
▸ Pełne NDA, obejmujące zakaz publikowania pracy w jakiejkolwiek formie (w tym portfolio i media społecznościowe), wiąże się z dodatkową opłatą.
▸ Jeśli NDA obowiązuje tylko do ustalonej daty, po której mogę opublikować pracę, dodatkowa opłata nie jest wymagana, o ile nie ustalono inaczej.
▸ Jeśli klient prosi jedynie o nieujawnianie swojej tożsamości, ale zgadza się na publikację pracy, nie obowiązuje dodatkowa opłata NDA.

7. MERCH FIZYCZNY

▸ Produkty fizyczne (np. printy, naklejki) sprzedawane są wyłącznie do użytku prywatnego.
▸ Kolory mogą nieznacznie różnić się w zależności od ustawień ekranu i procesu druku.
▸ Nie ponoszę odpowiedzialności za uszkodzenia lub zagubienie przesyłki po jej nadaniu przez firmę kurierską lub pocztę.
▸ Zwroty i reklamacje dotyczące merchu rozpatrywane są indywidualnie, w zależności od sytuacji.

8.FINAL NOTES

▸ Zastrzegam sobie prawo do aktualizacji niniejszego Regulaminu w dowolnym momencie.
▸ Zmiany cen lub zasad nie obowiązują wstecz dla zamówień już opłaconych.

Złożenie zamówienia lub dokonanie zakupu oznacza, że klient zapoznał się z Regulaminem, rozumie go i akceptuje.
